Will Decertifications Make the Teamsters Back Off?

I've heard that some people believe that the union is going to quit because a few workers at a few terminals have filed for a decertification election.

Click on this link for a copy of one of the flyers that I got from the Teamster organizers at the gate in Orange.

Looks to me like the workers at the Modesto terminal don't think that the guy who filed the petition, Anthony Rodriguez, speaks for them. It looks to me like the guys who signed the petition are thinking for themselves.

I believe that "modesto fights back" flyer thats all over the terminal is changing minds. Last night a dockworker handed me a card right in front of a supervisor. He wasn't afraid. Thanks bud, you showed the same kind of bravery that modesto showed this week.

Well I hear there was meetings this weekend. Is it all that secret? What happen this week?

It may be a normal week, or there might be some fireworks. The guys who met this weekend want their names to be held private. We have to respect that. I dont even know who they are, and I usually know everything. The teamsters have strick privacy rules, if you dont want people to know who you are, nobody will. Have a good week everybody, lets make it a peaceful transition.

We had a couple of cards signed last week. And a lot of people asking questions about all the terminals that are merging. Some guys are starting to change their minds about the union. I think there is going to be a lot of fireworks in July. Stay calm, get your answers and join us, we can do this. We will be a stronger company with more all term employees when we are union.

Maybe you guys know, maybe you dont. But the company is making big changes in July. And the supervisors have been told not to talk about it or answer any questions.

Well you guys who have questions should come to our meeting sunday morning at 0830. 140 S. Marks way in Orange. Close to 57 freeway. You can get your questions answered. I have been with the company for 18 years. USF Reddaway is a good company and as Teamsters we will be stronger with better benefits. And longer term employees.

Well the so called decert votes are now null and void. The company made them that way, by adding employees to union yards. The votes if any were ever planned to begin with, have to be re certified when you change employees around. The truth is, the company was bluffing to say there would be a vote in June. It never took place. And no vote has been annouced in July. The anti union people are not, and have never been the majority. There may be a few guys sitting on the fence because they dont understand the benefits, or they are afraid. But most of those guys want the the union too. If you dont know enough, find out. If your afraid because your new, dont be. The only people who have lost their jobs, are people without union protection. And keep in mind, in over 15 years here, the company has never fired people unless they lied or stole from the company. The company is not firing people for being pro union. They havent even fired the crazy guys with pro union stuff on their personal cars.

What if my employer doesn't know I am involved in trying to organize a union?
If your employer did not know that you were trying to organize a union, then the employer will argue that the decision to fire you could not have been in retaliation for that union organizing. Many employers use this reasoning to escape liability. Especially where workers are trying to organize under the boss's radar, it may be hard to prove employer knowledge of the protected activity. Still, the NLRB will use inferences to deduce who the employer may have suspected. If you were among a select few who had the courage to speak up, that might be enough for a judge to "infer" employer knowledge. Sometimes, the employer's investigation or interrogation of an employee can reveal employer knowledge of the protected activity.
To avoid this problem, some union organizers will announce their protected activities. For example, you could send the boss a letter (typically by certified mail) that says, "I plan to start talking with my coworkers about organizing a union." It could describe other protected concerted activities that you plan. This type of letter is called a "revealment" letter because it reveals who is organizing for the union. Certified mail has the advantage of creating a document that shows the date the employer received the item. If the retaliation occurs shortly after the organizing effort (say within six months, or sometimes longer), then the timing alone may persuade a judge that the employer's true motive was retaliation for your union organizing

UNION POWER ...
What is considered to be "protected activity?"
The NLRA protects the right of employees to:
organize unions;
bargain collectively,
engage in concerted activity, and/or
refrain from any of these activities.
So, when Norma Rae stood up and held a sign that said "union," she was protected from being fired for that act. Similarly, the worker who joins a negotiating committee and makes demands the boss thinks are too radical is also protected from retaliation.

DON'T LET MANAGEMENT TELL YOU SOMETHING DIFFRENT ABOUT THE TEAMSTERS, THAT THE TEAMSTERS WILL BE YOUR BOSSES, THATS NOT TRUE REDDAWAY WILL STILL BE YOUR BOSSES, THAT THE TEAMSTERS WILL LOWER YOUR WAGES THATS ALSO NOT TRUE, WHY WOULD WE JOIN THE UNION AND LOWER OUR STANDARDS, BUT THE REALITY IS WHEN JOINING THE UNION IS ABOUT IMPROVING OUR ECONOMICS, GAIN RESPECT, BETTER CONDITION WITH A CONTRACT NOT A HANDBOOK, GAIN AND IMPROVE OUR PENSIONS AND MEDICAL BENEFITS.
